Damage and Loss Policy
South OC Luxe Party Rentals – Damage & Loss Policy
This Damage & Loss Policy is an addendum to the South OC Luxe Party Rentals Customer
Rental Agreement.
1. Customer Responsibility
The Customer assumes full responsibility for all rental items from the time of delivery or
customer pickup until they are returned and checked in by South OC Luxe Party Rentals.
Items must be protected from theft, damage, vandalism, misuse, and weather-related
exposure (e.g., rain, high winds, moisture). Items should not be left unattended in public or
unsecured locations.
2. Damage Fees
If any item is returned broken, cracked, torn, burned, bent, stained beyond cleaning, or
otherwise damaged, the Customer will be charged:
- 2x the current replacement value of the item as determined by the Company, plus
applicable tax and fees.
- Labor fees may apply for extensive repair, deep cleaning, or restoration efforts if the item
is not a total loss.
3. Loss & Theft
For items not returned or reported as lost/stolen:
- The Customer will be charged 2x the current replacement value of each missing item.
- In the event of theft or suspected criminal activity, a police report must be filed by the
Customer and a copy provided to the Company.
4. Example Replacement Costs (for illustrative purposes only – not actual
charges):
- Folding Chair: Example replacement cost $30 = $60 charge if lost/damaged
- 60" Round Table: Example replacement cost $90 = $180 charge if lost/damaged
- Popcorn/Cotton Candy Machine: Example replacement cost $600 = $1200 charge if
lost/damaged
- Dance Floor Tile: $50 replacement value = $100 charge per tile damaged
5. Cleaning vs. Damage
Items returned excessively dirty may be subject to cleaning fees listed in the Rental
Agreement. Items that cannot be cleaned to usable condition will be deemed damaged and
subject to full replacement fees per this policy.
6. Disputes & Payment
Disputes regarding damage or loss charges must be made in writing within 3 business days
of receiving the final invoice. Charges will be applied to the card on file unless alternative
payment is arranged within 48 hours of invoicing.
